Welcome to Academy of Musical Expression (AME), a sole proprietorship owned and operated by Saikat De (“AME”, “we”, “us”, or “our”). These Terms & Conditions (“Terms”) govern your access to and use of our website (https://saikatde.com), learning platform (https://learn.saikatde.com), mobile applications, digital products, courses, memberships, and other services (collectively, the “Platform”).

By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree, please discontinue using the Platform.

1. Eligibility
You must have the legal capacity to enter into a binding agreement to use our Platform. If you are under 18 years of age, you may use our services only with the consent and supervision of a parent or lawful guardian.

3. Courses, Services & Digital Products
AME provides music education services, online and offline classes, memberships, digital downloads, learning resources, sheet music, TABs, and other educational content. Access to certain services may require registration or payment.

4. Payments
All prices are displayed in the applicable currency unless otherwise stated. Payments are processed securely through authorized third-party payment service providers. By making a purchase, you agree to pay all applicable charges, taxes, and fees.

5. Refunds & Cancellations
Refunds, cancellations, and rescheduling are governed by our Refund & Cancellation Policy, which forms an integral part of these Terms.

6. Intellectual Property
All content available on the Platform, including text, videos, audio, photographs, graphics, logos, trademarks, course materials, sheet music, TABs, software, and other intellectual property, is owned by or licensed to AME unless otherwise stated.

You may access the content solely for your personal, non-commercial learning purposes. You may not copy, reproduce, distribute, modify, publicly display, sell, share, or create derivative works without our prior written permission.

7. Acceptable Use
You agree not to:

• Share your account with others.
• Copy, record, download, or redistribute paid content without authorization.
• Upload unlawful, harmful, abusive, or infringing content.
• Attempt to gain unauthorized access to our systems.
• Interfere with the operation or security of the Platform.

We reserve the right to suspend or terminate access for violations of these Terms.

Our Platform may integrate or link to third-party websites, payment gateways, communication services, or learning platforms. We are not responsible for the content, policies, or practices of third-party services.

9. Disclaimer
Our courses and educational materials are provided for learning purposes only. Individual learning outcomes depend on factors such as practice, consistency, dedication, and personal ability. We do not guarantee any specific results, certifications, employment opportunities, or musical achievements.

10. Limitation of Liability
To the maximum extent permitted by applicable law, AME shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Platform or reliance on any information or services provided.

Our total liability for any claim arising out of these Terms shall not exceed the amount paid by you for the relevant service giving rise to the claim.

11. Indemnification
You agree to indemnify and hold harmless AME, its proprietor, employees, instructors, affiliates, and service providers from any claims, liabilities, damages, losses, or expenses arising from your violation of these Terms or misuse of the Platform.

12. Termination
We reserve the right to suspend or terminate your access to the Platform, without prior notice, if you violate these Terms, applicable laws, or engage in activities that may harm AME, its users, or its services.

13. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India.

Any dispute arising from these Terms shall first be attempted to be resolved amicably. If a resolution cannot be reached, the courts having jurisdiction in Kolkata, West Bengal, India shall have exclusive jurisdiction, subject to applicable law.

We may update these Terms from time to time. Revised versions will be published on this page with an updated “Last Updated” date. Continued use of the Platform after such changes constitutes your acceptance of the revised Terms.
